The English legal system is the cause of most of the problems that afflic UK

The PLC Party is a party of ordinary people in ordinary walks of life, doing ordinary things that ordinary people do and enjoying doing in the ordinary course of events. 

The Welfare State, which the PLC Party vows to overhaul bottom up, if the people are ready, able, and willing to give themselves the chance to participate in the management of the government business, is a product of the English legal system.  

Therefore, in this Part 2 of the PLC Party Manifesto – Complete overhaul of the Welfare State – a Proposal for consideration by the people of the United Kingdom in the run-up to the General Election, the emphasis is on the - English legal system

There is much wrong with the English legal system.  The English legal system is the foundation and origin of most of the problems facing the United Kingdom.  Whether one is thinking about poor town planning, poverty, anti-social behaviour, domestic violence, parochial terrorism, racial hatred, greediness, corruption, illiteracy, high incidence of criminality among the elites - all of these can be traced to the English legal system. 
 
A “system” is not like a “structure”.  A system reproduces itself.  The womb of a female is a “System”. It can give birth, again, and again and again. The “womb” of the earth is the ground upon which we trek. He who lives shall return to the womb of the earth at some point. 

The English legal system has given birth to many principles during the last 250 years.  However, the English legal system as it is operated by the Judiciary, Solicitors and Barristers, do not guarantee fairness, parallel or equality of treatment across the racial divide in any part of the United Kingdom .

The English legal system has capacity to accommodate unfairness and miscarriages of justice at home.  Many inhabitants feel bad and angry about the English legal system and English law makers.

The English legal system exports contradictions, such as racism, nepotism, corruption, racial hatred, intolerance, draconian penal policy, human rights violations to many countries that would otherwise apply commonsense and customary principles of natural justice when dealing with issues affecting their own nationals or citizens

The English legal system is not codified and by and large, Her Majesty’s Justices are above the law.  

The above points signpost the issues that have to be addressed.

What we are proposing

If the PLC Party is given the opportunity to participate in the management of the government business of the United Kingdom we would introduce the following measures into law –

1.  The Law Commission would be given additional powers to make urgent recommendation for a codified system; the English legal system, as it stands today, has outlived its usefulness

2.  Under PLC administration, we would abolish the two-tier system of legal profession – no more distinction between barristers and solicitors – all solicitors and barristers would be known simply as “Attorneys”.  Those in the employment of the Crown would be known simply as Public Attorneys.

{In August 1999, writing under the emblem of the Public Law Centre, I made a Representation to the British Judiciary and Government on this same subject; namely, a nation state of the size and importance of the United Kingdom does not need a two-tier system of legal profession.  A two-tier system of legal profession is a rip-off and always will.  Leopards never change their spots}

3.  Under PLC, we would abolish the office of the Treasury Solicitor (Tsol).  This Department employs some 3 600 “lawyers”, most of whom are “lawyers” in name only;

4.  Under PLC, we would merge the Attorney General’s Office and Solicitor General’s Office

5.  Under PLC, “Job-for-life” for Judges would be abolished.  Stipendiary Magistrates, County, Crown, or High Court Judges would hold their judiciary office for a maximum period of 10 years;

6.  Under PLC, Criminal Cases Review Commission would be abolished;

7.  Under PLC, Prisoners {other than those in a special category} would be received back into the community, with adequate financial support, on completion of one-third of a sentence;

8.  Under PLC, all government ministers and their parliamentary under secretaries must have “hands-on”, on policies while in office.  

{The current procedure in the civil service whereby “Direct Communications Unit” handles complaints or petitions from members of the public, without the knowledge of a minister, is an abuse of power.  It is also an abuse of power when civil servants, especially in the Home Office – UK Border Agency take decisions in the name of a minister who does not know anything of the decision taken in his / her name}

9.  Article 10 of the “Right of Habitation” shall be introduced into law.  Article 10 states –

“The administrative unit of state shall not, on its own motion, start, initiate or commence or institute proceedings against any named inhabitant upon the ground of that person’s root, beliefs or association in the mainstream society of other inhabitants”   -

This measure is all the more important to safeguard the country from parochial terrorism

10. Under PLC administration, the Supreme Court Act 1981 section 42 would be repealed  This obnoxious piece of legislation has put a deep hole in the integrity of the English legal system. No civilised jurisdiction would entertain this kind of law
