PETITION TO HER MAJESTY THE QUEEN OF THE NETHERLANDS
Put on Dutch Airline KLM 587 flight bound for Lagos, at 2.00 pm on Tuesday, 22 June 2010
We the petitioners BEG YOUR MAJESTY TO PLEASE, IN YOUR NAME AND IN THE NAME OF GOD, STOP illegal and unjust removal of Mr. John-Salakov from his home , children, grand children, and great grand children. It is only fair and in the interest of justice that, if the IND decides to remove him. He should be allowed to leave the country with his law library, his furniture, and other belongings.
We believe that it is wrong and unjust for the IND to remove a person to a country of which that person has never held its passport.
And we also believe that it is wrong an unjust for the IND to clone laissez passer in order to remove a person
In the present case, Mr. John-Salakov has never in his 67 years in this world held a Nigerian passport
We the petitioners, beg for your Majesty’s intervention because
- Mr. John-Salakov is a European citizen
- Mr. John-Salakov was born in Nigeria in 1943
- In 1959 , when he was minor he was registered as a British Citizen under the British Nationality Act 1948, Sec 7 to 9
- Also in 1959, he left Nigeria, for the UK, having been issued with a UK passport.
- He renewed his British passport on many occasions since that year
- But in 2003, when he applied to renew his passport as usual, the passport office in Newport, (Mrs Jill Walliker), Civil servant wrote to him saying that he must re apply for naturalisation. Decision Not made by the Courts but by Mr Tony Dalton, Civil servant working in the UK Border Agency)
- Mr. John Salakov challenged that decision in the Administrative Court in London
- In the presence of Mr. Justice Benjamin, he argued that, if he lost his birth certificate, and wanted a new one, would he be required to go back into his mother’s womb and be re-born before being issued with a new birth certificate?
- The home office was represented by the Treasurer Solicitor Department, ( A Mr. John Armstrong ) who was not qualified at the time represented the home office)
- Mr. Armstrong did not appear in Court but he filed a defence. At Para 2 of his defence, he admitted that Mr. John-Salakov was in fact issued a UK passport in 1959; and he further admitted that Mr. John-Salakov left Nigeria in 1959 and has since being living in the UK. However, Mr. Andre John-Salakov seemed to suggest that there was confusion in relation to the British Nationality Act 1983 alongside with the 1948 Section 6-9
- But Mr.Armstrong also stated that the government made a mistake for not pointing out to Mr. John-Salakov that the passport should not have been renewed over and over again
- Mr. Justice Benjamin did not make any ruling because he agreed with Mr. John-Salakov ‘s argument
- Between October 1996 and January 2007 Mr. John-Salakov‘s office in Brussels was in regular communication with the then Major of Rotterdam and with his statutory ( Ms Monica van Ert), concerning the opening of a branch office in the Netherlands
- At no time did the Mayor’s office objected
- In February 2007 the plc was registered in KVK in Rotterdam
- Between 2007 and 2010, there were regular correspondence between the former President Minister , Mr. Balkenede and Mr. John-Salakov and between the IND and Mr. John-Salakov
- The IND officers were fully aware of Mr. John-Salakov bond with the UK
- Jan 2010 the IND made an appointment for Mr. John-Salakov and his wife to attend an interview at the Staad Huis in Rotterdam the purpose of the interview was to put “a sticker “ on his wife’s passport so that she could renew it but what happened at that interview were not pleasant to repeat here.
- On the 24, 25, 26 February 2010. Mr. John-Salakov and his wife were invited guests at the UN World Alliance of Cities Against Poverty (WACAP) conference in Rotterdam
- Shortly after that conference. Mr. John-Salakov left Holland for a short period.
- On 21 March 2010, Mr. John-Salakov returned to Holland
- On 22 March 2010, IND police officers arrested both Mr. John-Salakov and his wife
- The events that took place on the balcony of Mr. John-Salakov ‘s home/ office on 24 march 2010 led Mr. John-Salakov to conclude that one of the IND officers did attempt to murder him
- This matter was raised in the Raad Bank Case Ref Number is: 201003514/2/V3
- On 30 March, Mr. John-Salakov's wife was removed from the Netherlands without any information having been given to Mr. John-Salakov.
- The removal was illegal and unjust
- And now, they are trying to do the same to Mr. John-Salakov what they did to his wife.
- When Mr. Wens, of the Ministry of Justice DT&V Division served the Vluchtgegevens (flight detail) on Mr. John-Salakov yesterday, 18/6/2010, he said ,”I am not going to discuss this with you, we will put you on that flight. If we have to handcuff you, or drug you , will take you to Nigeria”.
- Mrs. John-Salakov was drugged before being blunded onto the plane bound for South East Asia on 30 March 2010
- There are stories of many Non-Whites being deported and hand cuffed and put on flight even though they had no passport or proper travel document . Yet the whole world looks on.
- Mr. John-Salakov's asset in the Netherlands are in excess of 150,000 Euros. Yet the IND Officers are bent on removing him without allowing him to take any of his property with him.
- Mr. John-Salakov had eight adult children all born in England. He has 13 grand children and 3 great grand children
- Therefore, there is no excuse and no reasonable grounds to remove Mr. John-Salakov from the Continent of Europe.
- All- in- all , the IND police officers are waging a racial war against Mr. John-Salakov.
- No Court of law in any part of the European Union or anywhere else has issued a deportation order against Mr. John-Salakov.
- No Court of law in any part of the European Union or anywhere else has deprived him of his British Citizenship.
- In any event , he did not enter the Netherlands via Nigeria. He entered Belgium via the UK on the 8th November 2004, following approval to travel granted by the home office from waterloo station
- He entered the Netherlands via Garda Midi Station in Brussels.
- The facts surrounding that entry are already set out in this petition
- If Mr. John-Salakov were to be removed to any country at all , the one country that he should lawfully be removed to is the UK, where he has a bound of attachment which has spread over 51 years.
- The other country which Mr. John-Salakov can lawfully be removed to is Belgium, where he has other bound of attachment including the country’s national ID card
- It is worth pointing out that the Netherlands Raad vanState(Administrative Court Division) had examined Mr. John-Salakov’s case properly and that court has decided that it has closed the case due to the fact that the IND police officers have not produce any evidence that Mr. John-Salakov is illegal in the Netherlands.
- There is documentary evidence produced by Mr. John-Salakov to the Raad vanState. For the avoidance of any doubts the Case Ref Number is: 201003514/2/V3
- Having regard to the length of time that Mr.John-Salakov have spent outside the Continent of Africa including Nigeria, a total period of 51 years , he has practically forgotten the language.
We beg your Majesty to please help us to stop this unlawful action by the IND officers
